The Lawsuit

It was 31st of August. I woke up because someone was hammering on my apartment door like they were framing a wall with it.

I slept in my $19.90 black t-shirt and work boots by the door because I drove back from Greenwich at 3 AM after the party and didn't want to take them off. The glowing white oak stage was still on the lawn in Greenwich under a tarp Mike threw over it. The black Ford was hidden in the woods again. The rusty box was on my kitchen table, empty, because I gave Sloane nothing and she gave it back in the night; I found it outside my door at 4 AM with no note.

I opened the door. It was a process server. Little guy, 60s, Yankees cap, clipboard. He looked tired. He does this for a living, ruining mornings.

"Jack T. Hawthorne?"

"Yeah."

"You've been served."

He slapped a stack into my chest that was heavier than a box of tile. It was in a thick cream envelope with deckled edges. I knew that paper. $12 a sheet. Vivian's invitation paper. She used the same paper that she used to invite me, to sue me.

He was already walking away. "Have a good day!"

I closed the door and dumped it on the kitchen table next to the rusty box. The stack was 42 pages, bound with a blue backer, with a Superior Court of Connecticut stamp from yesterday; August 30th Which means her lawyers had this before the party. She invited me to humiliate me, and when I flipped it, she filed it the same night.

VIVIAN R. HAWTHORNE, individually and as Executor of the Estate of Thomas J. Hawthorne, and CHASE HAWTHORNE vs. JACK T. HAWTHORNE, individually and as Trustee of Hawthorne Holdings LLC.

I read the first page standing up, coffee not even made yet.

COUNT ONE: UNDUE INFLUENCE AND LACK OF CAPACITY

At the time of creation of Hawthorne Holdings LLC (2003) and execution of deeds (1988-2019), Thomas J. Hawthorne was suffering from congestive heart failure, prescribed oxycodone, and was subject to manipulation by his son Jack T. Hawthorne, who isolated him...

Isolated him. I was 5 when he bought the dirt. I isolated him by being born.

COUNT TWO: FRAUD AND FORGERY

Defendant Jack Hawthorne has fabricated and/or altered geological reports purporting to show $2.1 trillion in lithium deposits. Plaintiffs demand independent analysis.

COUNT THREE: MARITAL PROPERTY - APPRECIATION CLAIM

The $8,000 initial investment in 1988 was made during Thomas Hawthorne's marriage to Emily Hawthorne, but under Connecticut law, assets purchased during first marriage that appreciate during second marriage are subject to elective share of surviving spouse. Surviving spouse Vivian Hawthorne claims 50% of appreciation.

Fifty percent. $1.05 trillion.

Page 42 had a yellow Post-it note, handwritten, loopy and sharp.

Jack — Be reasonable. 50/50 and we drop everything. We can be a family again. No hard feelings about last night, you embarrassed us but we forgive you. Call Brown. Love, Vivian

Love, Vivian. Suing me for a trillion dollars.

My phone exploded. It had been on silent. 412 notifications.

Photo: Sloane and Vivian hugging in the white tent last night, pool house cropped out, filter so heavy they look like plastic.

Caption: Family over EVERYTHING. Some people will do anything for money and fame. My mom built this family for 20 years while others hid in Brooklyn playing with boxes. We stand together. Pray for us. #familybusiness #truth

Chase posted at 6:45 AM. LinkedIn AND I*******m. Same suit as last night, fresh, standing in front of the big house.

Video: "Hey everyone, quick truth bomb. My father had dementia the last two years. My brother Jack, who we love, took advantage of him and got him to sign papers. That Nevada land was bought with family money, my mom's money. We're going to court to protect my dad's legacy. Please respect our privacy. And Box Boy, see you in court."

I sat down on my cold floor. My 20 push-ups weren't happening today.

Brown called at 7:30 AM.

"Don't answer your phone. Don't post. Don't talk to Greenwich Time. Get on the next train to my office, now. She hired Sullivan & Cromwell. Do you know what that is? That's a $2,200-an-hour law firm that sues countries. Vivian hired a law firm that sues countries to sue you."

I took the LIRR. Hoodie up. In my work boots. I looked like a guy going to get fired.

Brown's office smelled like burnt coffee and fear. Mrs. Albright gave me a Xanax bottle and said "For James, not you, he needs it."

Brown had the lawsuit spread across his whole desk, highlighted in four colors.

"Okay, listen," he said, pacing. "This is actually good news. Terrible, but good."

"How is being sued for $1.05 trillion good news?"

"Because they asked for 50%, not 100%. That means their own lawyers told them they can't win 100%. They're opening at 50% to settle at 20%. That's their tell. They want $400 billion to go away. It's a shake-down. It's what rich people do when they know they have no case but they have a lot of lawyers."

"Can they win?" I asked. My voice was small.

Brown stopped pacing. He looked at me for a long time. This is the guy who knew Dad for 30 years.

"Jack, your father was married to your mother Emily in 1988. He bought the land in 1988 for $8,000 while married to Emily. Under Connecticut law, that's marital property of marriage one. Then he married Vivian in 2004. Under Connecticut law, a surviving spouse can claim an elective share of 1/3 of the estate's appreciation that happened during the second marriage. Vivian's lawyers are stretching that to say the lithium appreciation; which happened in the last 5 years, happened during her marriage, so she gets half. It's never been tested at this scale. No judge has ever decided a case where $8,000 became $2.1 trillion. The law was written for houses that go from $200k to $500k, not dirt that becomes a nation's battery."

"So a Greenwich judge could give her..."

"A Greenwich judge who lives on Elm Hill Road, whose wife plays tennis with Vivian, could absolutely give her $500 billion to 'preserve family harmony.' This is Connecticut. This is not justice, this is country club law."

He sat down. He was sweating.

"I have to ask you something and you have to tell me the truth. Did you ever, ever help your dad sign anything after 2022 when he was on painkillers?"

"No. He did everything himself. He filmed it. You filmed it."

"Good. Because they're going to depose Mike, Luis, everyone. They're going to say you isolated him. They're going to say you built that truck to manipulate him."

At 11 AM, while I was still in Brown's office, Mike called me, whispering.

"Boss, don't come to Greenwich. Town inspector came, yellow-tagged the pool house. CONDEMNED. Do not occupy. Chase told the inspector to go fuck himself and tore the yellow tag off. I have it on video. I'm sending it to you."

He sent it. Video: Chase in his suit, ripping a yellow condemned sign off the pool house that was sagging with water still pouring off it, saying "This is my property."

Brown watched it and actually smiled for the first time that day.

"Oh, Chase, you beautiful, stupid boy," Brown whispered. "You just gave us Count One of our countersuit."

That afternoon, Brown filed our answer. A war declaration.

COUNTER-CLAIMS:

Construction Negligence: Chase Hawthorne built a structure that failed in 4 days, endangering the public.

Demolition Without Permit: Vivian Hawthorne demolished a historic workshop (Mr. Hawthorne's workshop) without town approval to hide evidence of waste.

Defamation: Public false statements calling Jack a forger.

And Brown subpoenaed everything. Every text between Chase and his contractor where he said "use interior sheetrock to save $4k." Every invoice where Vivian approved cheap waterproofing. Every I*******m DM where Sloane called me Box Boy.

At 4 PM, Vivian called Brown's office. Mrs. Albright put her on speaker. I was in the back room listening.

"James, it's Vivian. This is getting ugly. Tell Jack to be reasonable. He's 26, he doesn't need $2 trillion. He can have $500 million, that's more than enough for a boy who lives in Queens."

Brown said, "Vivian, you just sued him for $1.05 trillion and you're telling me $500 million is more than enough?"

"James, we are family," she said, voice cracking, but I knew that crack. That's her charity gala cry, practiced.

"We are," Brown said. "And Jack is keeping his dirt. See you in court."

He hung up and I came out of the back room.

"Your dad told me once," Brown said, "that the reason he bought 4,000 acres of nothing for $8,000 is because no one would fight him for nothing. He said, 'If I buy something valuable, the vultures come. If I buy nothing, I can hold it until it becomes valuable.'"

"He waited 35 years for it to become valuable," I said.

"And the vultures came in 12 hours," Brown said. "Your family."

He handed me the papers.

"Take this home, Box Boy. Put them in your rusty box. It's the only thing that box has ever been good at holding; other people's garbage."

I took the train back to Ridgewood with a $1.05 trillion lawsuit in a grocery bag, because I didn't have a briefcase.

In my apartment, the glowing white oak stage photos were already on Zillow Gone Wild: "Greenwich Pool House Collapses Hours After Trillionaire Reveal."

And my phone buzzed again. Sloane, from a private number I didn't know she had: Jack, I'm sorry. They made me post it. Mom said if I don't stand with her she cuts me off. I didn't mean it. The box is still yours. - S

I didn't answer.

The 90 days of staying quiet were done.

Now the real 90 days were starting; the 90 days of fighting my own family for dirt my dad bought before I was born, while living in a $1,800 apartment that smells like dryer sheets.

I put the lawsuit in the rusty box. It fit perfectly.
